I think the Fair Trading Act might be more down the right path, although the Commerce Commission or Consumer Affairs might be able to advise!

I think it falls under the Fair Trade act.
I've sent an email complaint to the Commerce Commission:

Still going to email the Herald to see if the story gets picked up

Just called Consumer as I'm a member and their advisor is wasy today but will give me a call tomorrow.........

I had a email rant to 1-day and now they're offering me a refund as well as a $50 store credit because I threatened them with the newspaper and commerce commission..... I have also found out through consumer.org that they did the exact same thing in december when they were allegedly selling ab circle pro..... I'm pretty sure they ARE worried about the commerce commission but the consumer advisor also told me that we, as customers have no stronghold at all in this case....

Really disappointed about this - I'd bought one too and then got the email saying they'd refund instead. I'd already told DH all excited that I'd got one

i didn't buy one, but just wanted to say that this also happened a while back when they sold those zhu zhu pets...that weren't the real thing.
i would steer clear I think.

Only just logged on and saw this post, but I visited the 1-day site that day and thought 'Gee, that's cheap...' - but before I even thought about purchasing one, they didn't specifically say where they were made (ie Mocka) or any indication of brand, and I instantly thought - doesn't look like the real deal to me.
I've made a few purchases from them before, and have not had any problems, but it pays to read all the info thoroughly coz they often have 'lookalikes' at real good prices.
I just wish I'd come here and shared with you guys what I thought before you all snapped them up.
Hope you all get refunds/store credits from them.

Mocka actually have them on special at the moment anyway, I think they are about $50; so a bit more pricey but still a good deal if you are wanting one specifically.
