EEEK!
Can anybody help? I am getting confuzzled!
I am commencing paid parental leave on the 22nd of July. However, I have 16 days annual leave accrued which my employer informs me cannot be paid out to me before I go on leave! I plan to return in 6 months, but what will happen to this leave? Will it be calculated at a reduced rate?
Any advice on how to get this paid out NOW would be grand! I don't want it diluted!

Is it possible to change dates with work and IRD and go on AL first? it will depend when bubs is due. I took all of Sept off as AL, then PPL kicked in Oct, and B was born half way thru Oct. Does mean if I go back that any AL I accrue and take will be at that reduced rate for a year.

My Mum is an HR manager and says that annual leave has to be paid out at that time, if asked.

I had 10 weeks owing to me when I started my PPL and it was paid out on my first day (3 weeks before my EDD). So they have to pay it out.
They're trying to dodge that as they know that when you come back it will be next to worthless to you, meaning they have to fork out less money.

They paid my annual leave out to me on each pay run which was awesome, so I was still basically getting a weekly wage until my PPL started.

Call the Department of Labour or check out the website...

It sounds like you're work is trying to be seriously dodgy.  Don't let them bully you.  I'd email the HR person and/or your manager and advise that you wish to have a meeting to discuss this and that you will be bringing a third party representative.

I know lots of people who took their AL at the begining of their leave and then had the PPL start after that.

I didn't, but I've just gotten off the ph with work just this minute and I'm going to get my AL paid out now, at my normal hourly rate. (46 days wwoooooohoooo)

My work doesn't pay out annual leave either when going on matenity leave. I work for a big reputable company - I think is becoming more common and depends on your work and contract.

I had 2 weeks AL so I left work mid-January - had 2 weeks "holiday" and then my official first day of maternity leave was 01Feb. I then got PPL from 01FEB.

Make sure you calculate out that your last day would be XX day as I could also accrue hours for the 2 weeks holiday before I left for PPL - hope that doesn't sound confusing.

If you request then they have to give it to you. But if you don't take it before bub if you resign it should be paid out at the rate it was before going on PPL.

Shouldn't any leave you have accrued before you go on leave still be there when you go back to work i.e. why would you lose it?
Not sure if this applies for everyone but I still accrued annual leave when I was on paternal leave, albeit at a reduced rate.

Yep it would still be there but they wouldn't have to pay out the same $value as 6 months you haven't been paid for, making your 8% less than what it would be if they pay it out at the time of going on maternity leave.
So basically her company are just being tight arses.

If they won't pay the leave out before you commence PPL then you should be able to ask for it to be paid out afterwards. I.e 14 weeks PPL then x weeks annual leave then the rest of the 6 months as unpaid leave.

Failing that I would phone up the department of labour and ask for their advice.

I took some of my annual leave owed to me prior to my PPL kicking in, therefore leaving work earlier.

And the balance will be paid out in full when I resign at the end of my PPL in 3mths time.

I don't understand what you mean by 'diluted'. How could your accrued leave reduce in value?? Now you've got me confuzzled

hmm, I think i get you now - your accrued AL is yours in full as you have earned it to date. Though you won't continue to accrue AL while on PL for that 6mths until you return again. When you return it would still be sitting there for you to take as annual leave from then on.

I work in Local Govt and they don't 'pay out' AL either - you have to take it as holiday and have it paid out while actually 'on leave'. You could spend another 16 days away from work at the end of your 6mth PL and have it paid out to you then?

Why not leave work 16 days before your PPL begins and have it paid out that way?

I don't get it I had 76 hours accrued when I left for PPL and I will get that ALL paid out, in full, at the rate I was on at the time of going on PPL when I resign in October - that's what my payroll dept told me?

I could have it wrong. I took my leave before getting PPL as I needed to leave work a bit earlier than 34 weeks so didn't have this problem myself. Perhaps they just discount the time on unpaid leave?
