Does anyone know about getting sick leave paid out when you leave a job? Someone I know is maybe going to leave a job they have been doing for 15years (she is devastated) and she has a huge amount of sick leave unused (something like 120days)....I know it prob depends on her contract, but just wondered if it is likely that she will get her sick leave paid out?

I'm not an expert but I don't think you get sick leave paid out.

From the Department of Labour website:

"Accumulation of sick leave

Under the Holidays Act 2003 an employee can carry over unused sick leave. For example, if someone uses only one day's sick leave from the five day entitlement in a 12 month period, he or she may carry over the other four days, so in the next 12 month period the total entitlement is nine days' sick leave. The maximum accumulation under the Act is 20 days' leave, although employment agreements can provide more generous accumulation.

Accumulated sick leave cannot normally be exchanged for cash, nor form part of any final payment to the employee on resignation or termination, unless the employment agreement requires this."

That would be awesome if you could though! (Well, for me not the employer) I could have been paid out on something like 35days when I left my work as they had very generous sick leave entitlements. However, I doubt they would be as generous with their sick leave if they had to pay out that much whenever someone left!

Thanks so much - yeah 100+ sick days to pay out would be nice. She has taken hardly any off in the 15yrs she has been there....

I always take my sick leave even if its only for a mental health day. Don't use it you lose it.

It depends on your employer. I definitely took more than the government allocated 5 days sick leave last year and the year before. I seemed to get every cold going around. I was even guilty of taking the odd "mental health day" but most of it was proper sickness. I was nowhere near using up the sick leave that my employers allocated to us. As I said - I ended up with still 35 days sick leave I could use and I'd only been there 2 and a half years. So, I can imagine with an employer like mine that it would be very easy to rack up 120 days of sick leave in 15 years even with taking sick days.

As a bit of an aside - I think having more than the five sick days a year is very sensible, it means that people stay away just that extra bit longer and less people get sick from sick people still coming to work because they have no more sick leave owing or want to save the sick leave for something more serious. My sisters work has unlimited sick days for their staff for the same reason. I haven't heard of anyone abusing the system - although there are people that go the other way and still come into work because they feel guilty for staying home. However, we are both professionals - I suppose it wouldn't work as well in places where people work for minimum wage and would rather not be there.

My mum fakes sickies rather than taking her annual leave as she knows if she leaves it won't be paid. She usually just takes mental health days though!

Me too! I could never fake a sicky, I can't stand it how people take the p*ss like that. Sick days are for when you are sick, you don't get the time off by right!

She faked one today but that is because she has a job interview tomorrow she needs to prepare for. She doesn't do it for the hell of it.

I get 10 days sick leave according to my contract - find that's a fair amount and as someone said, encourages me to stay home and properly recouperate... I don't often get all that sick but I think that I'm more prevention than cure so if I feel like I'm heading downhill health-wise I'll take a day.

Must admit, because they don't usually get paid out (actually never heard of that happening!) I am not adverse to taking a mental-health day, but do try to time if for a quiet day where my absence wouldn't put too much extra strain on my workmates.

Heh, if a "mental health day" is going to make me more productive for the rest of the week and beyond then I'd say it's a good thing for the company. Please note this is not an every week thing, it's a once or twice a year thing.

I'd rather a workmate take a day off than come to work p*ssy and unproductive. An unproductive and grumpy person at work is a waste of space and would annoy me FAR more than someone taking a sick day - they are far better off lounging at home at coming back to work happy the next day.

My old job use to have unlimited sick leave...those were the days. Imagine the payout then! lol

We have 'unlimited' sick leave but in reality if you go over 10 days a year you have a little meeting with the big boss! I never really had sick days, probably because Ive contracted for a few years part time and if you dont work you dont get paid.

In terms of it getting paid out - unless its in the contract then no. But contracts that were written a while ago have some funny clauses. My dad had been at the same place 30+ years and when he left he got paid out mega bucks (atleast his annual salary) becuase of accumulated annual leave, and possibly sick leave.

I walked away from my job today - devasted, after too much stress being the target of a bully boss.

I was told I had 2 weeks sick leave.  So I've turned around and taken it as "stress leave" while my lawyer sorts out the "Exit package".   Needed a doctor's cert which I got this morning.

In normal circumstances, I don't believe sick leave is paid out upon leaving a job.

If i was her employer I would be pissed. if i was her workmate and had to do extra because she was away i would be pissed too.

i have basically unlimited -my job seems to do all it can tomake it easier for me to be sick - well, away if i really am sick. i would feel really bad taking advantage of it. espcially as when i had appendicitis, my boss turned up with a big bunch of flowers, some baking and a card from every one....and strict instructinos that they didn't want to see me for at least a week.

She was told to take it as sick leave. (They are restructuring at her work, 6 jobs cut to 4)

I guess it depends on the circumstances. My dad has used up some of his sick leave over the last few weeks...one day he actually had the doctor, but the rest was to try and sort out some stuff because his loyalty over the past 5 or so years was rewarded with a letter arriving in the mail saying he was being made redundant...they didn't even have enough respect for him (or the other staff) to tell them in person.

I get 5 days a year, plus a further 10 if required. I have used 2 of them, from memory...both times I was actually sick.
