Topic: Using a Surrogate Mother: What You Need to Know Posted: 29 November 2019 at 8:40am |
There's still some controversy about using a surrogate mother to have a baby. The legal process is also tricky because it varies from state to state. Even so, whether it's because of fertility problems or other reasons, surrogacy is an option for childless couple. But a lot of questions follow from here. Who should use the services of a surrogate mother? How to find a surrogate mother? Is it better to do the search yourself or go to the clinic? There are also opinions that surrogacy abroad is cheaper. What do you think about this?

Hello! Right now, there aren't any regulations about who can be a surrogate mother. However, experts agree on a few points about how to select one.
You should choose a surrogate who:
Is at least 21 years old. Has already given birth to at least one healthy baby so she understands firsthand the medical risks of pregnancy and childbirth and the emotional issues of bonding with a newborn. Has passed a psychological screening by a mental health professional to uncover any issues with giving up the baby after birth. Signs a contract about her role and responsibilities in the pregnancy, such as prenatal care and agreeing to give you the baby after birth. In my opinion, it is more important to discuss the legal issues of surrogacy.

Thanks for your reply! Indeed, legal issues regarding this issue are extremely important. While a surrogate has rights, the right to keep the child is not one of them. Once legal parenthood is established, the surrogate has no legal rights to the child and she cannot claim to be the legal mother. In the same vein, the contract protects the surrogate from any kind of legal or medical responsibility for the child. It’s important to remember that your surrogate’s motivation is not to keep the baby. Comprehensive screening, which includes a full mental health evaluation, clinical interview, and records review, helps ensure this. Her goal is the same as yours – to help you build your family.

Yes, but it all depends on the country. Indeed, today in many countries surrogacy is prohibited. In this regard, childless couples have to go abroad. Although it is known that abroad the cost of this service is much lower. However, the choice of country and clinic must be taken seriously. Indeed, everywhere there are different laws, for example, in Russia, the right to motherhood is determined by the woman who gave birth to a child. In Ukraine, on the contrary, the law is on the side of biological parents.

One of the most important aspects of a surrogacy match is the legal contract. It’s equally crucial for both parties – intended parents want the security of established parental rights, and a surrogate's rights and protections as a gestational carrier must be addressed too. A surrogate should be well educated on the physical and medical implications of surrogacy to make the best decision for her. Medical consent is a major provision within a surrogacy contract. It means that both the intended parents and surrogate must agree to testing for medical conditions and communicable diseases. Before the match is confirmed, it’s also important to discuss termination to ensure you share the same feelings and beliefs. Depending on the state and source of the eggs and sperm, additional steps may need to be taken after the birth.

As for the cost, undoubtedly, abroad, in particular in Ukraine in Biotexcom, the cost of surrogacy is several times less than in America and Russia. As for Asia, I did not consider it for these purposes. When planning a trip for surrogacy abroad, it is advisable to consider this Ukrainian clinic. However, it is important to note that in order to join the surrogacy program in this clinic, you must have medical indications. Also, the services of the clinic will not be able to use gay couples. Laws in Ukraine stand on the side of biological parents. In addition, the clinic’s lawyers help with the preparation of all documents, so no legal problems will arise.

Thanks for the recommendation and useful advice. I know that Biotexcom is a very popular Ukrainian clinic. I found out the cost of services, indeed they are lower than in many other clinics. Yes, indeed, a lot depends on the choice of clinic. However, sometimes choosing a clinic is not so simple. After all, you need to consider many factors: cost, rating, location, and so on. The choice is not easy, but there are good options!

I had positive experiences with the Feskov clinic in Ukraine! Although many people talked us out of going to Ukraine. "Where are you guys going? There is Chernobyl! There is Donbass! You won't see any money or children." My husband and I were scared. However, many people from the showbiz come here, and we learned about the clinic from a famous person. We arrived in Kharkov, we were greeted by a nice employee who spoke English. The city is beautiful, huge, modern. Very nice people everywhere. The Feskov clinic is the most advanced. No useless information, everything about the case, clear and precise. Immediately informed us of all the risks and offered several options. In UK, the doctors completely dissuaded us from success. They said that nothing could be done and that we should accept or take a child from an orphanage. We were happy because we paid for a result that was achieved. If it is impossible to get your own eggs, the clinic offers donor eggs. But fortunately we didn't get there. The skilled doctors woke up my ovaries. the biggest miracle was our long awaited baby! We knew in advance that we were going to have a boy, because the sex selection service was also included in the package. There are reviews of couples on their YouTube channel https://www.youtube.com/watch?v=C5TPtc5tocA&list=PL23nwpXwH2Wj3yU9ZeGhaoUtLT4OEUbZu&index=31Regarding legality, I found a Ukrainian law translated into English. I recommend everyone to read it. https://www.mother-surrogate.com/pdf/surrogate_motherhood_law.pdf
