I need some advice re family court.
My child's father (who live's in a different city) has applied to the family court so he can have access to my son. I left the father when I was ten weeks pregnant and my son is almost one. The father has visited him all of four times since he was born. There is a history of domestic violence (hence the reason I left). What chance does he have of the family court granting his wish that he can take my son back to his city for visitation (would involve a trip on a plane).
Any help would be appreciated. I am beside myself with worry that I will have to hand my son over for god know's what period of time.
I think your best bet is to talk to a laywer about this. Sorry dont have any other advice for you as such. Maybe some of the other girls can help you on where exactly to go ect.

I always feel a bit sad when I hear about DV. Are you able to prove that there was DV? I am sorry as I am not able to give much help, I have two wonderful step sons, which after a long four and a half years, have become there legal guardian.

You would be able to plead your case of DV and also the fact it would be some what trumatic for your son to spend time alone with a man he doesn't know and a man that doesn't know his routine etc. For these reasons he would most probably be granted surpervised visitation with either you or your mother or someone that knows your son well. After 3-6 months of very regular visits he would probably be able to take your son on his own for 2-3 hours at a time to begin with. Because you are his full custodian(he only lives with you) then there would be no chance for him to take your son out of the provence without you or your full premission or this would be parental kid napping.
Citizens advice bureau have free lawyers you can talk to for advice on matters like these. I know it all seems so scary but the courts really do have the childs best interests in mind so there is no way they would order you to send you son to a man that your son wouldn't be comfortable with.
I hope this helps a bit my first daughter Chloe's biological father lives in another city and he was violent and a dangerous driver so I was terrified that he would be granted visitation without there or worse that he would take her in his car. Anyway when he first wanted to pick her up(when I lived in the same town) in his car and take her to see his new girlfriend I went straight to see a lawyer and found all this out.

Domestic violence is the number one problem many families have right now. I know from my own family that it is a real problem. But it is solvable if you just turn to specialists.
